2. Products main features

The products are listed directly on the Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. website with their essential features. For each of the products viewed, the Customer will have access to a special data sheet with the main information about the product, in accordance with art. 9 and 14 of Regulation (EU) No 1169/2011 of the European Parliament and of the Council, such as name of food and list of ingredients, including those that may cause allergies and intolerances (for certain foods), product’s quantity, storage conditions, etc.

3. Booking and purchasing

In order to purchase products online from the e-shop, the Customer will have to access the http://www.goppioncaffe.it/. In the e-shop, you can select and book the individual products offered. You simply need to indicate the quantity and confirm after selecting any further option desired. In this way, the products will be added to the virtual cart.

You can add, delete or confirm all reservations made up to that point. In order to confirm the order, the Customer must pass through the authentication:

– if already registered, simply use your email address and password.

– if not yet registered, you’ll be required to do so, indicating all the required data.

Purchase will be completed by Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. only when the order is confirmed by email, fax, or by the “VS order confirmation” form. The confirmation will be sent out within 2 working days from receipt of the order. The email contains the ordering details, the price of the purchased product, the shipping costs and any additional charges, the address the product will be delivered to, delivery time, and the information about the right of withdrawal. The Customer should print and preserve the order’s confirmation. According to art. 12 of Legislative Decree No.70 / 2003, Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. informs the Customer that any submitted order is stored in digital form in the server at the website hosting provider and in paper or digital form by Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. itself, in accordance with secrecy and security criteria.

 

4. Availability of products and selling price

All products in the e-shop are available and in stock. If there are unexpected delays in delivering the products, the Customer will be promptly informed via email, as well as in the event of temporary unavailability of one or more products.

Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. ships to Italy. Each item shows the unit selling price expressed in Euros and is inclusive of VAT and any other tax. The cost of shipping and any additional charges, if any, are not included in the purchase price, as they’re indicated and calculated separately.

Shipping charges may vary depending on the type of delivery selected, the quantity of products to be dispatched, their volume, weight and place of destination; the charges will be visible during the purchase procedure and on the “VS Order Confirmation” form.

5. Payment methods

The Customer may use the following methods for payment:

a. Credit card from the most common circuits: VISA, MASTERCARD, VISA ELECTRON, AMERICAN EXPRESS, DINERS

b. PAYPAL

c. POSTE PAY

Transactions will be carried out in accordance with bank security regulations. However, Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. assumes no responsibility for any fraudulent or illicit use that can be made by third parties (e.g., credit cards) upon payment of purchased products, as long as it can prove that it took all possible precautions based on the best science and experience available at the time and on ordinary diligence.

Since completing the purchase procedure implies the obligation of the Customer to pay for the chosen products, it is stated that when the order is dispatched, which as indicated above means the conclusion of the contract with Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l., the obligation to pay is mandatory.

 

6. Delivery of goods and shipping costs

All products ordered by the Customer and confirmed by Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. will be shipped by Express Courier (national and international) to the address indicated by the Customer. The shipment cost will be highlighted during the purchase procedure and on the “VS Order Confirmation” form, in relation to the order’s country of destination.

The product’s shipment will be fulfilled once the payment of the order has been regularly confirmed by Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l.

Products shipped to Italy are delivered within 3-4 business days of shipment. Shipments are made Monday to Friday. Any changes to this schedule will be promptly communicated to the Customer by email.

7. Import duties and customs duties

The products sold are not subject to any import duties or customs duties if the product is sold and delivered in Italy or within the European Union.

In the case of deliveries to non-EU countries, the products may be subject to import duties and/or customs duties depending on the type of product and country of destination. Therefore, it’s not possible for us to predict in any way what costs may occur for customs clearance of the goods.

For more information, Customer will be required to contact the customs office of their country. In any circumstance, costs related to import duties and/or customs duties will be paid by the Customer.

8. Right of withdrawal

The Customer is entitled to withdraw from the purchase without any penalty and without obligation to specify the reason within 14 (fourteen) days from the date he/she physically received the products purchased online.

In order to exercise the right of withdrawal, Customers are required to inform Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. of their decision to withdraw from this contract by explicit statement using the “Download Form” (downloadable here) and then send it to the email address goppion@blitzmicro.com, or by fax to n. +39 0422 260028.

In any case, without delay, the Supplier shall acknowledge receipt of the Customer’s withdrawal notification by sending a specific email. In order to comply with the terms of withdrawal, Customers simply need to send a notice regarding their decision to exercise the right of withdrawal before the expiry of the withdrawal period indicated above. It should be noted, however, that certain products may be excluded from the right of withdrawal as they are goods that are likely to deteriorate or expire rapidly, in accordance with Article 59 para. D) of Legislative Decree no. 6 September 2005, n. 206, Consumption code.

The shipping costs that may occur during the return of the goods are borne by the customer. In order for the right of withdrawal to be valid, the items must be returned intact and in perfect condition in their original packaging (sealed with shipping adhesive tape) and addressed to:

9. Withdrawal effects

If a Customer withdraws from the Contract, they’ll be refunded the price of the returned goods without delay and no later than 14 (fourteen) days from the day the Supplier is informed of the Customer’s decision to withdraw from the Contract. In any case, the Customer will not bear any costs as a result of such refund. Refunds may, however, be held until the products are received and their conformity is proven.

To be eligible for the refund of the price paid, products must be returned intact and in their original packaging, i.e., the Customer did not open the package of the product purchased online. In the latter case, the right of withdrawal is not valid, as confirmed by Article 59, E) of Legislative Decree no. 6 September 2005, n. 206, Consumption Code. Therefore, it is impossible for the Customer to withdraw from contractual commitments related to the online purchase or to request a refund of the amount paid for the purchase itself.

However, in the case of purchasing a package containing several distinct products, each with its own separate package, a partial withdrawal, i.e., for just some of these products, is permitted, provided that they are whole and therefore were not opened by the Customer.

The Customer is required to return the products to blitz micro s.r.l. Strada Scudetto 23 31100 Treviso (TV) without delay and within 14 (fourteen) days from the day they notified their wish to withdraw from the contract. The term is respected if the products are returned within 14 (fourteen) days.

The products must be returned with a package insured in Porto Franco (free economic zone). No parcel shipped as C.O.D. or port assigned will be accepted by Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. The sole expenses incurred by the Customer for the exercise of the right of withdrawal are those for the return of the products to the Supplier, borne by the Customer only.

10. Warranty

Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. guarantees the compliance of its products with the updated industry standards and their preservation by the expiry date stated in the package. The products must be stored by the Customer in accordance with the instructions provided in this regard and always in areas where hygienic and environmental conditions are suitable for the products themselves; consequently, Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. will not be liable for disputes concerning products that have not been retained by the Customer in accordance with the above-mentioned requirements.

Any non-conformity of the products may be raised by the Customer in accordance with the current consumer protection regulations, and in particular the Legislative Decree no. 6 September 2005, No. 206 (Consumption Code). The complaint of non-conformity of the products must be sent to Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. as specified in the following point 12. In case of non-compliance, Goppion Caffe Spa | ECommerce Partner blitz micro s.r.l. is responsible for providing a free replacement of the non-compliant product within reasonable time.

11. Applicable law and jurisdiction

These terms of sale are governed by Italian law. Controversy arising in connection with these terms and conditions (including non-contractual disputes) are subject to the exclusive jurisdiction of the local courts of Italy, provided that this does not affect the right of parties to seek proceeding in any other competent jurisdiction, in accordance with the applicable procedural law.
